Mediation

One of the alternatives to lengthy and costly litigation is the use of mediation. It is a form of alternative dispute resolution (ADR) that provides a way of resolving disputes between two or more parties.

We are third party mediators who provide a neutral environment where the parties are free to negotiate a settlement of their own choosing. CDCI conflict resolution solutions in a variety of environments affecting business relationships, workplace disputes, individuals, community issues, business and contract disputes. CDCI also provides mediation services internationally where applicable.

CDCI provides participants the opportunity for a speedy resolution, control of the process, privacy, and confidentiality. It also has the added benefit that the results are enforced by the courts.

CDC Integrated Services uses the Transformative Mediation Process which is designed to defuse and change the adversarial relationship of the parties and shifting their focus toward a principled negotiation process that allows the parties to explore alternatives in a constructive and objective manner. For more on the Transformative Model read blog post Thoughts on Models and More dated January 17, 2014.

Arbitration

Arbitration is a form of dispute resolution where the parties in conflict agree to submit their dispute to a neutral third party whose decision is legally binding and enforceable. This form of alternative dispute resolution (ADR) is a technique for resolving disputes outside the courts.

Once the parties agree to arbitration, they agree to be bound by the decision of the arbitrator.  CDC Integrated Services provides arbitrations services consistent with “JAMS” Comprehensive Arbitration Rules and Procedures.

Negotiation

Everyone negotiates, but most are not aware they are doing it,  and it is an inherent part of everyday life. The purpose of any negotiation is to reach an agreement that resolves a point of difference or an understanding of a course of action.

In its most common applications, it is typically a give and takes process where the parties (whose goals and objectives initially conflict) seek a common ground from which to fashion an agreement or understanding. It is a process that seeks a solution or set of solutions based on compromise.

When CDC Integrated Services undertakes a negotiation on behalf of a client it does so on the principle that the goal of the party(s) is to preserve and advance the existing relationship and that the substantive outcomes of the negotiation are to achieve that purpose.

We help our clients understand the strengths and weaknesses of their positions at the negotiating table.

Conflict Resolution

CDC Integrated Services believes in the principle of Self-Determination and uses the “Interest-Based Relational Approach” (IRB) in resolving conflicts involving both organizations and individuals.

We find that this approach is the more effective approach for identifying the needs, perspectives and motivations that underlie many conflicts.

IRB, as it is often called, focuses on the interests of the parties, and is CDCI’s preferred method of facilitating conflict resolution. Do you have conflict in the workplace?

We encourage our clients to see us as a “go-to” resource and place CDCI on retainer. Our retainer fee is competitively priced and assures our clients of a rapid response.

CDCI offers conflict coaching/training for executives. Our rate schedule is available on the services page.

Contract Disputes

Contract disputes lie in wait to damage any business relationship. We at CDCI can unravel the knots. See our videos here.

CDC Integrated Services knows from experience that well-managed contractual relationships can experience unresolved issues that develop into contract claims. Some are minor and are quickly resolved, but others, like an untended field taken over by weeds and thickets, are consumed by wasteful conflict and arguments.

High-risk contracts, such as those with aggressive milestones and demanding scheduling requirements, are particularly vulnerable to unresolved claim conditions, and CDCI can help in evaluating contract claims to aid clients in determining a path forward.
